Terms of Service

A 20% retainer is required at booking to secure all session dates and times. In the event of a cancellation or postponement of the portrait session/agreement by Client, the retainer paid is non-refundable. Retainers are transferable up to 3 times if a date change is necessary due to illness or weather. Forty-eight hours notice of postponements or cancellations is appreciated. If it is not possible for a session to take place on a scheduled day due to weather, Photographer will announce a rain date. If Client cannot attend the rain date, Photographer and Client will reschedule on an agreed date at the earliest date possible, with no additional charge.

Photographer is not responsible if Client and/or key individuals fail to appear or cooperate during portrait sessions. If the photo session must be rescheduled due to clients cooperation where the photographer has traveled to reach the destination, additional travel fees will apply.

All images are copyrighted to and remain the property of Donna Rae Photography. This means that Client cannot alter images in any way, or sell for a profit.

Client is obtaining digital files in JPEG format for personal use only, and shall not sell said files or authorize any reproductions by parties other than Client or Photographer. Prints for publication (such as editorial, public relations or advertising use) require prior written consent from Photographer. A credit line which reads “Donna Rae Photography” in type no smaller than that of the related text must appear adjacent to or within all permitted published photographs. Low-resolution digital files are provided in JPEG format at 640 x 480 resolution for free with each session. Client understands prints must not be made from these low-resolution images and are for digital viewing and sharing on social media only. When posting these images, Client must give credit to Donna Rae Photography. High resolution digital files are delivered in JPEG format within two weeks of session date as well as a print release. Photographer does not provide RAW images to client.

Client grants Photographer permission to display selected images from their session as an example of Photographer’s work and for entrance into photographic competitions and releases all claims to profits that may arise from use of images.

Donna Rae Photography will take the utmost care with respect to the exposure, retouching, and transportation of digital captures, proofs and prints. However, in the unlikely event that all the originals are lost, stolen, damaged or destroyed within or beyond Photographer’s control, Photographer’s liability is limited to the refund of all payments received, or a re-shoot can be scheduled at no additional cost. The limit of liability for partial loss or damage of originals shall be a prorated amount of the total amount, based on the percentage of originals lost or damaged. In the unlikely event that Photographer is injured or becomes too ill to attend the portrait session, Photographer will make every effort to reschedule to the earliest possible date.

Client is aware that color dyes and inks in non-archival prints may fade or discolor over time due to the inherent qualities of dyes and inks, and Client releases Photographer from any liability for claims whatsoever based upon the fading or discoloration due to the inherent qualities when prints are not purchased from photographer. Prints purchased from the photographer are guaranteed against natural light fading and will be replaced in the case of unexpected bleaching.

Session fees are determined in advance based on the collection chosen, number of individuals to be photographed, the location of the photo shoot, and will always be announced at the time of the session release. The balance of the session fee is due the day of the session before arriving on location. Please no exceptions. Payment plans can be made available to help alleviate the cost of the session. Any session that requires travel outside of the 50 miles round trip covered in the session fee will be charged at $0.50 per mile.

Additional prints not included in the session fee through the photographer are ordered a la carte and subject to 6% sales tax. All prints include standard retouching and shipping through the U.S. Postal Service. Prints generally ship via Priority Mail two to four weeks after Client’s print order has been paid in full. Rush printing and shipping can reduce delivery times by one to two weeks. A 50% rush fee is applied to the cost of each rush print.



Donna Rae Photography will perform standard retouching on all images deemed worthy of the brand. Standard retouching includes light blemish and stray hair removal. Complex retouching includes such changes as the removal of scars or heavy blemishes. Tonal conversions include converting color images to black-and-white. Files are automatically lightly retouched and available in color and black and white for no added fee. Complex retouching may be requested and is billed at $50/hour.
